A Notary Public, or Notarius Publicus, performs a public function by checking and certifying specific facts connected with documents and legal acts. County Administrative Boards appoint notaries and publish the authorised persons for each area. This means the certification is performed by someone with a formal appointment, not simply by any lawyer, accountant or private witness.

A Swedish Notary Public may certify a signature, certify that a copy corresponds to an original, verify authority or company signing rights and, in appropriate cases, certify translations or other document-related facts. A Notary Public can also issue an apostille when the document and destination fall within the Hague Apostille system.

The certification must be distinguished from the content of the document. A certified copy does not automatically prove that every statement in the original is substantively correct, and an apostille does not oblige every recipient to accept the document. The notarial certificate identifies the particular fact checked: for example, the identity behind a signature, correspondence between copy and original, or authority to represent a company.

A sound case therefore begins with the recipient’s exact wording rather than a search for the nearest office. When do you need a Notary Public and which documents are common?

The need commonly arises when a Swedish document will be used abroad or a recipient requires formal proof of a fact. Individual cases include powers of attorney, passport copies, education records, civil-status documents, inheritance papers, adoption, property transactions and bank matters. Company cases often involve registration certificates, board resolutions, annual reports, contracts, export records and evidence of signing authority.

A certified copy allows a recipient to avoid holding the original while receiving an independent confirmation that the copy matches the document presented. The Notary Public normally needs to see the original. A scan, a printout of a photograph or a copy witnessed by a private individual is not automatically equivalent to a notarially certified copy.

For a witnessed or certified signature, the signatory will normally need to prove identity and sign in the presence of the Notary Public, or follow another method accepted by that notary. Do not sign a power of attorney in advance if the recipient requires a witnessed signature. Otherwise a fresh document may be needed.

Company files may require a recent registration certificate, articles, board minutes, a power of attorney or other evidence showing who may represent the company. Notary Public, apostille and legalisation: what is the difference?

An apostille is an international certificate under the Hague Apostille Convention. It simplifies the use of public documents between participating states by replacing the longer traditional legalisation chain. In Sweden, only a Notary Public may issue an apostille. The apostille authenticates the relevant signature, seal or official capacity; it does not endorse the substantive content of the document.

Where the destination uses the Apostille Convention, a properly issued apostille normally removes the need for further diplomatic legalisation. The recipient may still require the correct document version, an authorised translation, a recently issued original or a certified copy. Check both the country and the specific organisation’s instructions.

If the destination does not use apostilles, the document may instead require legalisation. In Sweden, this often involves the Ministry for Foreign Affairs authenticating a Swedish signature and seal, followed by the destination country’s embassy. Private documents, powers of attorney, copies and corporate records may need a Notary Public certification before the MFA stage.

There are also exceptions. Under EU rules, certain public documents moving between EU Member States have been exempt from apostille and legalisation since 2019. The exception does not cover every document or recipient. Ask whether a multilingual standard form, an authorised translation or the ordinary original will be accepted.

A well-prepared case can begin digitally. Provide a readable copy of the full document, the recipient’s instruction and the destination country. This makes it possible to assess whether you need a new original, certified copy, witnessed signature, translation, apostille or legalisation and to place those steps in the correct order.

The next question is whether personal attendance is required. When identity and signature are being checked, the signatory will often attend with valid identification. An apostille for an existing public document can often be presented by a representative or handled by post, but the procedure is set by the Notary Public performing the act.

Bring the original, all copies that need certification and every attachment forming part of the document. Do not separate, restaple or sign multi-page documents without instructions. Companies should bring current authority records. If wording is required in English or another language, agree the final text before the appointment.

After the checks, the notarial certificate is issued. If an apostille is required, the Notary Public attaches or adds it to the qualifying document. If legalisation through the MFA or an embassy is needed, the chain continues under the destination’s rules. For translations, the order between original, certification, authorised translator and final authentication can be decisive.
